LEARNING LIVE
These terms and conditions (T&Cs) apply to the training courses offered by Learning Live. Learning Live may add and withdraw training courses at any time without notice.
Each Learning Live training course has a course descriptor, published on the website at www.live.edu.au which sets out relevant information and requirements for the training course.
1.1 Student Information
Prior to enrolment all students will have access to information on the course they are undertaking, including course outcomes, delivery, employability skills. Students also have access to information about Learning Live policies including RPL/RCC, fees and refunds, complaints and grievances, legislative compliance and support services.
Our aim is to provide you with the very best learning environment possible. To ensure that this happens we have in place policies and procedures. These policies and procedures are available in the Participant Handbook on the Learning Live website. 1.2 Student Induction
Learning Live is committed to providing opportunities to all people for advancement in training on an equitable basis. Individuals can access information on courses delivered by Learning Live on the web or from Learning Live directly.
Learning Live ensures that students gain maximum benefit from their training. All participants are required to complete the registration and to make payment to hold their place in the course (the name you have noted on your registration is the name that will appear on your Certificate).
Your position in the course is confirmed when all fee costs have been fully paid to Learning Live.
Student Induction begins prior to the commencement of the course. Students can access our ‘Participant Handbook’ on the Learning Live website. Students who enrol online are not required to sign the “Student Declaration”, this is confirmed by ticking “I have read and understood the Terms and Conditions.”
Students are required to sign the ‘Student Declaration’ acknowledging that they understand and agree to the Terms and Conditions of enrolment as outlined in the ‘Student Handbook’. On commencement of the course a thorough induction will be undertaken by the trainer and assessor. During the induction, students will also receive specific details relating to their course, for example a program outline, recommended reading list and initial manuals and handouts.
Students are also briefed on the WHS policies, Student Services, and Information about the facility and equipment.
1.3 Access and Equity
Learning Live is committed to access and equity in the provision of training and related services.
Learning Live supports equal opportunity in the selection of staff, trainers and students and agrees to:
- Promote access to training for people regardless of gender, socio economic background, disability, ethnic origin, sexual orientation or race.
- Ensure training services are delivered in a non-discriminatory, open and respectful manner.
- Ensure all staff members are appropriately skilled in access and equity issues.
- Conduct student selection in a manner that includes and reflects the diverse student population.
- Encourage the participation of students from traditionally disadvantaged groups.
Learning Live takes great care to ensure that all students and staff are treated fairly and equitably and does not tolerate any forms of discrimination or sexual harassment. All persons on site (including visitors) have the right to an environment free of discrimination and harassment.
Learning Live ensures that all students are provided with an equal opportunity to learn and progress through their course without harassment and discrimination. Training resources, techniques and assessment tools are free from discriminating material.
Learning Live ensures that students derive maximum benefit from the course and will select students on the basis of their ability to fulfil the course eligibility requirements. Learning Live ensures employees and those seeking employment, students and those seeking enrolment, are treated equitably.
This means:
- Enrolling people based on their skills, aptitude and relevant qualifications including life experience.
- Recognising and valuing different skills and ideas.
- Ensuring a workplace and learning environment, which is free from discrimination and harassment.
- Giving everyone an equal chance to develop skills and make the most of their talents.
- Supporting staff, trainers and assessors and students to combine work, study and family responsibilities.
Learning Live will not tolerate discrimination on the basis of gender, pregnancy, race, culture, marital status, ability or gender preference.
1.3.1 What to do if you are discriminated against or sexually harassed
You have the right to feel safe and to have full opportunity to achieve your potential in your study. Don’t let harassment interfere with your life. If you are being harassed seek help immediately. There are several options. Choose the course of action you feel most comfortable with. Do not ignore discrimination or sexual harassment, thinking it will go away – often discrimination just gets worse and silence may give the impression that discrimination or sexual harassment is acceptable.
You may:
- Tell the person they are making you uncomfortable and ask them to stop,
- Make a formal complaint in writing to Learning Live, or
- Make a complaint under Anti-Discrimination Legislation to the NSW Anti-Discrimination Board:

1.4 Privacy and Confidentiality
When you enrol at Learning Live the personal information you provide is protected under the Privacy and Personal Information Protection Act 1998. This Act imposes obligations regarding the collection, storage, use and disclosure of your personal information. The information provided will only be that which is necessary for the purposes of your course enrolment, learning and study records and for Australian Skills Quality Authority (ASQA) or other governing bodies for auditing purposes only.
Learning Live takes all reasonable steps to protect personal information from misuse, loss, unauthorised access, modification or disclosure including restricted access to electronic files, secure storage of paper files and back up of data.
From time to time we will use your information internally to forward details about specials, or other courses you may be interested in undertaking. In accordance with the Privacy Amendment (Private Sector) Act 2000, we invite you to advise us if you wish to have your name removed from our internal mailing list. If you have privacy concerns, or do not wish to receive this information, contact our office directly.
Learning Live ensures the privacy of students in the following ways:
- Information is only collected with the knowledge and consent of the student.
- Personal information is only used for the purposes for which it was collected.
- Personal information will not be sold or distributed to a third party without prior consent of the individual.
- Personal information will not be disclosed to other state institutions or authorities except if required by law or other regulation.
- Demographic and other statistical information is not linked to any personal information that can disclose the identity of an individual.
Learning Live takes all reasonable steps to ensure that information we hold, use and where appropriate disclose to others about students is correct and current. The accuracy of this information is largely dependent upon the student providing the correct details.
If you wish to access your own files please forward your written request to the General Manager.
1.4.1 Student access to personal records
A student may access their files at any time. To request to see their records a student must apply in writing via email to training@live.edu.au and provide two forms of identification. Students can also log in using their username and password to view their own records. Normally access can be provided with 48 hours of the request. Learning Live will release student files to the student only.
No third party can request to view student files unless they are the students appointed Power of Attorney. If students find any errors in the records they are to advise Learning Live immediately so that corrections can be made.
Should Learning Live (RTO ID 41067) cease operations, Students will be given access to all completed documentation. Students will also be given notice of any cancelled courses and will either be refunded for the course cost, or moved to another RTO to complete the equivalent training.
1.5 Code of Conduct
Learning Live is dedicated to excellence and to working with people who share the values of excellence, integrity and responsibility.
Policies and general management practices are created and adhered to, around the achievement and maintenance of high professional standards in both the marketing and the delivery of our courses, safeguarding the welfare of all participants in our programs. Marketing of programs is carried out with integrity, is accurate and conducted in a professional manner. We recruit participants in an ethical and responsible manner.
We are continually providing a high standard of service to our students, ensuring that we uphold the services that are currently provided to you. Our employees, representatives and service providers conduct our services in an honest, efficient, fair and transparent manner. We are committed to responding to our participants queries and concerns in a timely manner. We develop innovative ways to deliver training, responding to feedback provided by our students. We ensure that our trainers and assessors are knowledgeable and well respected coaches. We ensure that our students receive great value from our training programs. We providing dedicated Student Support functions to ensure students are well catered for and have an avenue for questions and queries.
1.6 Workplace Health and Safety
Learning Live is committed to the provision of a safe and healthy environment for its students, staff and visitors. Learning Live takes all ‘reasonably practicable’ steps to provide and maintain a safe and healthy workplace and learning environment. A successful Workplace Health and Safety program is dependent upon all persons on the Learning Live premises sharing responsibility for ensuring a safe and healthy environment.
Learning Live accepts its responsibility to be aware of and enforce the provisions of all relevant Acts, Regulations, and Learning Live Policy and Procedures. Learning Live has the responsibility under its ‘Duty of Care’ to provide as far as is practicable:
- A safe place of work
- Safe systems of work
- Safe tools and equipment
- Ongoing training in safe methods of work
- Safe, positive supervision at all levels
- Periodic inspection of all Learning Live physical assets and activities
- The investigation of all accidents, the reporting of all hazards and the implementation of all practicable control measures to protect people and property
- To encourage staff, contractors and students to implement sound health and safety principles in all their activities
Learning Live requires all staff, students, contractors and visitors to act responsibly and to comply with statutory requirements and all safety Policies, Standards and Guidelines
Each student is responsible for ensuring the safety and health of her/ his environment by:
- Making themselves aware of the relevant Learning Live policies, procedures and instructions;
- Complying with all Learning Live policies, procedures and instructions
- Taking reasonable care of themselves and others in the workplace
- Co-operating with management so that employees and contractors of Learning Live carry out their duties as required under the Workplace Health and Safety Act
- Reporting all known or observed hazards, incidents and injuries
1.6.1 Hazard Reporting
If an individual sees any item of plant, any procedure or any incident which has caused or has the potential to cause injury to people or damage to property, and it cannot be immediately rectified, they must inform Learning Live as soon as possible.
1.6.2 Incident/ Accident or Injury Reporting
Any individual who is injured or involved in an incident/ accident at Learning Live must inform their immediate manager as soon as possible.
1.6.3 Smoking
The No Smoking Policy prohibits anyone from smoking while on Learning Live premises, smoking must not take place less than 4 metres from entrances. This includes the areas immediately outside entrances to the building.
1.6.4 Evacuation Procedure
Upon hearing the evacuation hooter, all staff and students must immediately move to the designated assembly area and follow the instructions provided by the warden. The building must not be re-entered until students and staff are instructed to do so by emergency personnel.
If the evacuation siren sounds:
- Go to the fire exit as directed by the warden.
- Only take your personal belongings.
- Advise the warden of any injured person as soon as possible.
- When you get outside, go to the nominated assembly area and remain in class groups until instructed otherwise.
- The trainer will indicate the nominated assembly point for the training site.
1.6.5 Student Illness
Anyone suffering from temporary sickness, which could affect others such as colds, flu or viral infections should not attend until fully recovered. Students unable to attend due to illness must advise Administration immediately.
1.7 Student Support Services
Learning Live offers support and information to students to achieve their learning goals and to achieve satisfactory progress towards meeting the outcomes of the course. Students are invited to contact Learning Live staff if they are experiencing any particular study difficulties or language barriers, etc. Staff will be available to provide assistance and referrals as appropriate.
Students receive support applicable to the Learning Live program being undertaken. This may include mentoring sessions, phone and email access to the trainer/ assessor. Learning Live provides the opportunity for students to participate in services or provides services designed to assist students in meeting course requirements.
If students require medical assistance, Learning Live will ensure contact is made with emergency services or a medical practitioner on request of the student.
Students requiring counselling or support should first discuss the matter with staff. The staff will assist where possible, and in the event that further action is required in areas outside staff qualifications, the student will be referred to the appropriate organisation or service. Alternatively, the student may wish to contact the relevant organisation themselves from the list provided on page. For more comprehensive information you may need to refer to other directories.
1.8 Language, Literacy and Numeracy (LLN)
Learning Live aims at all times to provide a positive and rewarding learning experience for all our students. It is essential that the student has language, literacy and numeracy skills sufficient to approach training and assessment at the level of competency reflected in the AQF qualification and detailed in the Training Package from which their course of study is drawn.
Learning Live endeavours to ensure its training design supports learners, by allowing flexibility within delivery and assessment (under guidance of the training package), employing strategies such as:
- Use of demonstration of tasks in a simulated environment
- Verbal explanations – Questions and answers
- Use of diagrams/ charts
- Decreasing reliance on written forms and text
- Incorporating actual workplace materials, or modelling tasks on familiar workplace activities
A preliminary Language, Literacy and Numeracy (LLN) assessment will be undertaken at enrolment as and if required. Where LLN competency is essential we will make every effort to ensure that you are adequately supported to enable you to complete your training.
1.9 Employability Skills
Employability Skills are also sometimes referred to as generic skills, capabilities or Key Competencies. The Employability Skills describe the required generic competencies for effective participation in work. Employability Skills have business and industry application and are incorporated within all courses delivered by Learning Live. The eight key employability skills are:
- Communication
- Teamwork
- Problem solving
- Initiative and enterprise
- Planning and organising
- Self-management
- Learning
- Technology
2.0 Enrolment
An application to enrol an individual onto a Learning Live training course (participant) must be made through the Learning Live booking portal at www.live.edu.au. All enrolments and enrolment applications are subject to these Terms and Conditions (T&Cs). These T&Cs apply to the participant and (if different to the participant) the Financially Responsible Person as stipulated.
Learning Live is not obliged to accept any enrolment application. Enrolment of a participant on a Learning Live training course is subject to a place being available for that participant at the time the application is submitted. Places are allocated in order of receipt of the enrolment application form or information and payment.
The person submitting an application to enrol an individual onto a Learning Live training course must stipulate on the application whether the invoice for the fees associated with the training course will be payable by another party on behalf of the participant (for example the participant’s employer) or the participant themselves (the paying partying being the Financially Responsible Person) and include the correct billing address for the Financially Responsible Person.
The person submitting an application to enrol an individual onto a Learning Live training course must provide a valid purchase order, work order number, customer reference number and corporate pass number when enrolling in the course.
A written acceptance of enrolment of a participant on a Learning Live training course will be sent to the participant and the Financially Responsible Person with details of the training course including venue, date and time of the course.
2.1 Participant’s details and course pre-requisites
All details of a participant provided on an enrolment application must be true, accurate and valid as at the date of submission of the application.
All training course pre-requisite requirements that are described in the Learning Live course descriptor for the Learning Live training course must be met by the participant prior to the application to enrol the participant on the training course.
Learning Live reserves the right to request evidence that proves the details provided of a participant are true, accurate and valid as at the date of submission of the application; and/ or all course pre-requisite have been met by the participant prior to the application to enrol the participant on the course.
Where evidence requested by Learning Live is not provided to Learning Live’s satisfaction, then Learning Live may in its discretion cancel the participant’s enrolment in the training course and the Financially Responsible Person must pay cancellation charges in accordance with the cancellation policy based on the date of such cancellation.
2.2 Special requirements
All information relating to disabilities, special needs or learning difficulties (special requirements) of a participant that may impact on the ability of the participant to participate or complete the Learning Live training course must be disclosed on the enrolment application.
Learning Live will make every effort to accommodate special requirements of a participant. Where Learning Live cannot reasonably accommodate the special requirements of a participant disclosed within the enrolment application, course entry will be refused and no course fees will be payable. Learning Live is not liable for any loss or expenses (direct or indirect) whatsoever in such circumstances.
Where Learning Live cannot reasonably accommodate the special requirements of a participant not disclosed within the enrolment application, course entry will be refused and the full course fee will be payable by the Financially Responsible Person. Without limiting clause 12, Learning Live is not liable for any loss or expenses (direct or indirect) whatsoever in such circumstances.
2.3 Training course changes
Learning Live reserves the right to cancel any training course because of insufficient enrolments or other unforeseeable circumstances beyond MAWTA’s reasonable control (for example, accident or illness of the instructor). Learning Live will liaise with the Financially Responsible Person to transfer the participant to another course date. If the participant is not transferred to another date, no course fees will be payable.
If Learning Live cancels a training course under the cancellation policy, the liability of Learning Live for an enrolled participant is limited to refunding any course fees that have been paid by a Financially Responsible Person for that participant with respect to the cancelled training course. No refund will be made if the participant is transferred to another course date. Learning Live is not liable for any other loss or expenses (direct or indirect) whatsoever, including travel and accommodation.
Learning Live reserves the right to change the designated venue or instructor. Any substituted venue will be within a reasonable radius of the original venue. Notice of such changes will be sent to a participant and the Financially Responsible Person as soon as possible after changes have been made.
3.0 Fees and Qualifications
3.1 Fee Policy
Learning Live allows students access to clear and accurate information relating to fees and refunds prior to their enrolment in a training program. Enrolment Fees MUST be paid prior to the commencement of the course, to ensure your enrolment is secure.
3.2 Course fees
The course fee for a Learning Live training course is provided when enrolling on the training course. All course fees are in Australian dollars (AUD). The course fee is inclusive of GST (where GST is applicable). The course fee for a Learning Live training course includes tuition and all relevant course materials.
3.3 Payment
The Financially Responsible Person must pay a course fee, additional fee, late fee, transfer fee, cancellation fee and/or training record fee (as applicable) within 7 days of the issue of an invoice by Learning Live for the fee.
If any fee payable under these T&Cs is not paid by the due date, a late fee will accrue in the amount of $30 each 7 day period (or part thereof) that the fee is overdue. The late fee is payable by the Financially Responsible Person on demand.
3.3.1 Additional Expenses
In the event that a participant or a Financially Responsible Person have special requirements with respect to the provision of a Learning Live training course (for example, for the course to be delivered at a specific non-standard site) Learning Live will advise the participant or Financially Responsible Person (as applicable) of the additional fee (if any) that will be charged by Learning Live to meet that special requirement. Where an additional fee is stipulated by Learning Live for a training course, that additional fee must be paid by the Financially Responsible Person.
3.4 Refund Policy
All refunds are subject to the refund policy and must be applied for in writing to the General Manager with documented evidence of the reason for withdrawal. The NSW Funded administration fee and RPL/RCC fees are non-refundable. Refunds are based on the following guidelines:
- If a course is cancelled by Learning Live for any reason.
- You have overpaid the fee to Learning Live.
- In all other cases, refunds are at the discretion of management and may be negotiated on an individual case-by-case basis..
When entitled to a refund fee, students may choose to have their fee credited towards the cost of future training, rather than receive a refund. Fees in credit will be held for 12 months from the date of the training session. These funds are not able to be refunded or credited.
All refunds must be applied for in writing. Please contact Learning Live for more information on our Refund and Cancellation Policy.
3.5 Cancellation, Transfer and Substitution
The enrolment of a participant on a Learning Live training course maybe cancelled by notice in writing to Learning Live by the participant or Financially Responsible Person. The enrolment can also be cancelled online through the training management system.
The following charges are payable by the Financially Responsible Person where an enrolment is so cancelled:
- Clients are eligible for a 100% refund on training, with no cancellation fees, where 3 business days or more notice is given prior to the commencement date of training.
- If clients provide us notice of cancellation of their training within 3 and 1 business days prior to the commencement date of training, then 50% of the fee is payable.
- If less than one business day’s notice is provided prior to the commencement date of the training or non- attendance, then 100% of the fee is payable.
An approved substitute must comply with these T&Cs as if he or she were the original enrolled participant, including (but not limited to) all training course pre-requisite requirements for the Learning Live training course.
A request may be made to transfer the attendance of a participant from the enrolled date for a Learning Live training course to another date on which the same training course will be run. No transfer may occur without the prior approval of Learning Live, approval is at the discretion of Learning Live. No more than one transfer is allowed per enrolment.
A request to transfer the attendance of a participant from the enrolled date to another date must be made no less than 48 hours before the enrolled date. If the request is made less than 48 hours before the enrolled date and approved by Learning Live, the Financially Responsible Person must pay a transfer fee of $30.
If a request to transfer is refused by Learning Live and the participant does not attend the enrolled training course, charges as above will apply.
3.5.1 Failure to attend or complete
If a participant fails to attend a Learning Live training course, no transfer to another training course will be permitted and the full course fee will be payable by the Financially Responsible Person.
If a participant attends a Learning Live training course but leaves before he or she complete the training course, the full course fee will be payable by the Financially Responsible Person and transfer to another training course will be at the discretion of Learning Live. If a transfer is permitted, the transfer fee is payable.
4.0 Training Delivery and Assessment
4.1 Start Times and Arrival
The start time of a Learning Live training course must be strictly observed by a participant due to the technical and safety requirements of training courses. A participant must arrive for the Learning Live training course at least 15 minutes prior to its scheduled start time.
Late admission to a Learning Live training course will be at the discretion of Learning Live. If a participant is not permitted to participate in a Learning Live training course due to late arrival, no transfer to another course will be permitted, and in such case the full course fee will be payable by the Financially Responsible Person and Learning Live is not liable for any loss or expenses (direct or indirect) whatsoever, including travel and accommodation.
A participant must complete a ‘course sign-in sheet’ each day of a Learning Live training course. Failure to do so may result in the participant not being certified as properly attending and completing the training course.
4.2 Delivery of Training
Learning Live provides a competency-based approach to training in a Classroom setting. Competency-based training (CBT) is an approach to vocational education and training that places emphasis on a person’s ability to demonstrate a set of skills, knowledge and understanding.
Competency standards are determined by industry and set benchmarks of performance that set out the skills, knowledge and attitudes required to operate effectively in a specific industry or profession. All assessments conducted by us observe the directives as required by the Competency Standards for Assessment from the National Training Package for Training and Assessment (TAE40116) and NVR Standards for Registered Training Organisations.
Students do not receive a graded mark, they are deemed either Competent (C) or Not Yet Competent (NYC), i.e. they are able to complete the task or not yet able to complete the task. To attain a competent assessment, students must demonstrate the ability to perform tasks and duties to the standard expected in employment.
If students need information on their progress, they can ask their trainer and assessor.
4.2.1 Our Trainers
Learning Live requires all Trainers and Assessors to maintain qualifications and experience as specified by the Australian Skills Quality Authority (ASQA) in the following areas;
- Hold the TAE40116 Certificate IV in Training and Assessment from the Training and Education Training Package as a minimum qualification
- Be able to demonstrate vocational competencies at least to the level being delivered and assessed either by holding the specific qualification to be delivered and assessed, or by demonstrating equivalence of competency at the unit level
- Be able to demonstrate how they are continuing to develop their VET knowledge and skills as well as maintaining their industry currency and trainer/ assessor competence
Courses are delivered through face-to-face group classes. A variety of theoretical, experiential, practical and interactive delivery strategies are employed in the classroom. Strategies may include trainer presentation and demonstration, observation and practice, workshop practice, written work, discussions, question and answer sessions, case studies, projects, role play and structured exercises.
4.2.2 Materials and equipment
A participant must wear the applicable clothing, and bring (at the participant’s cost) the resources and Personal Protective Equipment (PPE), stipulated in the course descriptor for the Learning Live training course.
Where there is no specific safety clothing stipulated in the course descriptor for a Learning Live training course, the participant must wear flat closed-in shoes, short or long sleeve top (No Singlets). If a participant fails to comply with any requirements in this policy, Learning Live reserves the right to refuse training course entrance or remove a participant from the training course.
If Learning Live refuses entry to or removes a participant from a training course, the full course fee will still be payable by the Financially Responsible Person and Learning Live is not liable for any loss or expenses (direct or indirect) whatsoever, including travel and accommodation.
4.2.3 Student Feedback
Student feedback is one of the techniques used to obtain information from students undertaking our training. Your feedback enhances student learning and support, and to identify where courses need improvement.
Students are asked to complete a post-course evaluation form on the last day of the course. This allows Learning Live to gather feedback on the course, our trainers and our general service. Please note this can be filled out anonymously and all information is considered Private and Confidential.
4.3 Assessment
Assessment is carried out in accordance with the Assessment Guidelines contained within the nationally endorsed Training Packages or the assessment requirements specified within accredited courses curriculum documents and demonstrate compliance with the four principles of assessment:
- Valid
- Reliable
- Fair
- Flexible
These principles of assessment are addressed in the:
- Design, establishment and management of the assessment system for Training Packages
- Development of assessment tools
- The conduct of assessment
The four Rules of Evidence guide the collection of evidence and address the four principles of assessment. Learning Live demonstrates compliance in the four rules of evidence by collecting evidence which is valid, sufficient, current and authentic.
The assessment and evidence requirements, as far as possible, are designed to avoid putting an undue workload on participants. Methods of assessments may include a combination of the following:
- Case Study
- Observations
- Role Play/ Simulation
- Short questions and answers
- Supervisor or third party report
- Portfolio
- Written assignments/ Projects
- Questions/ Discussions
Each Student will receive a program outline, which details each unit covered in the course and scheduled assessment/s. Prior to assessment the trainer/ assessor will ensure that students:
- understand the purpose and consequences of the assessment
- have received copies of the relevant unit(s) of competency
- understand what evidence is to be collected
- are aware of the due dates and penalties for late submission
- have a complete understanding of the complaints and/ or appeals process
In order to be awarded the qualification for a Learning Live training course that is accredited by an external body (as outlined in the course descriptor), the participant must successfully complete the training course and course assessments within the time frame outlined in the training agreement that is issued to the participant by Learning Live following enrolment.
Statements of Attainment or Certificates of Attendance for a Learning Live training course that is not accredited by an external body may be awarded and issued to a participant who is determined by Learning Live as having successfully completed the training course and course assessments.
A certificate, qualification or statement will be issued by Learning Live or its providers only in the name of the participant provided in the enrolment application.
A participant may request a reprint or copy of a certificate, qualification and statement. Learning Live will issue the reprint or copy only after payment of the applicable fee – $30.00. Note: For some courses a reprint is not possible due to the certificate being numbered by an external authority. These authorities issue identification cards for the completion of the training and should be contacted for lost or stolen cards.
4.4 Handing in Assignments
An assignment completed on or before the due date should be given directly to your trainer. All written assignments submitted should have a completed Assessment Cover and Declaration Sheet clearly setting out the student’s name and assignment details and the student section signed. Alternatively, it may also be handed in at Administration. The Administration Officer will pass it on the trainer.
If the assessment evidence submitted meets the requirements of the unit of competency, the student will be assessed as competent. If the evidence does not meet the requirements of the unit of competency, it is important that students discuss their resubmission with their assessor. Students will be given one (1) opportunity only to revise and resubmit assessments.
If a student is dissatisfied with the results of their assessment they have the right to appeal the results by following the Complaints and Appeals policy and procedure. Learning Live assumes no responsibility for assignments that have not been signed in at Administration or handed directly to the Trainer.
4.4.1 Extensions
Learning Live will consider extensions for assessments to ensure that the student is given every possible opportunity to achieve competency and to meet the individual needs of students. All written assignments should be submitted on or before the due date as specified in the program outline. Assessment extensions will only be granted in extenuating circumstances. The student will be expected to apply in writing (via email, fax or post) to the Administration and request an extension at least 48 hours prior to the assessment deadline.
Compassionate or compelling circumstances are generally those beyond the control of the student, when they impact on the student’s course progress or wellbeing. These include:
- Serious medical condition or injury, accompanied by a medical certificate
- Bereavement of close family members
- A traumatic experience
The student will be notified in writing and contacted by phone by Administration if the request for extension has been granted. The student will be informed of the final deadline for all outstanding assessments. If the student fails to meet this deadline they risk a NYC result for units of competency where assessment tasks have not been fully completed.
4.5 Recognition of Prior Learning (RPL)/ Recognition of Current Competence (RCC)
Recognition of prior learning is the process by which individuals can have their prior qualifications and informal learning recognised formally through assessment. Recognition of current competence is the term used when individuals want the skills and knowledge that they are currently using for a particular job/ role recognised.
Learning Live recognises that all students may have prior learning or current competence relevant to their proposed course of study developed through their previous formal or informal training (RPL) or work experience and/ or life experience (RCC). Students may apply for RPL/ RCC. Those students indicating that they require RPL/ RCC will be provided with a Kit. You must be enrolled in the course and have paid the enrolment fee or equivalent before applying for RPL/ RCC. The details of this process are stated in the Kit. Staff are available to provide guidance and support.
Assessment mechanisms used are valid, reliable, flexible and fair and are conducted in an ethical manner.
4.6 Recognition of Qualifications
Learning Live will recognise all AQF qualifications and statements of attainment issued by other RTOs. Learning Live will seek verification of the certification from the relevant RTO where there is some ambiguity.
Credit transfer is available to students enrolling in a course. Credit transfer allows students to count relevant, successfully completed units of competency towards their current course.
Credit transfer works in two ways:
- Students receive credit for units they have previously completed and are exempt from retaking them, therefore reducing the study load.
- Students are exempt from certain introductory units but are still required to complete the total credit points or hours for the course.
Credit transfer may also be referred to as ‘advanced standing’.
4.7 Withdrawal
Learning Live is committed to ensuring students make an informed decision regarding withdrawing from or partially completing a training course. If you are considering withdrawing from the course, please consult your trainer to discuss the reason, as there may be other options available to you to complete the course.
If you simply stop going to class and handing in work you risk receiving a NYC grade. Requests to withdraw from a course must be submitted in writing by either completing the Withdrawal Form or sending an email to training@live.edu.au.
There is no automatic re-entry into a future course if students fail to complete all units of competency in the course in which they were originally enrolled.
4.8 Change of Enrolment Details
It is your responsibility to notify us of any change of name, address or employment, which occurs during the term of your studies with us. We are required to hold your full legal name in our records. If for any reason you change your name after you enrol with us, you need to provide us with details of your name change and a verified copy of the document to support the change.
If you change your address or any contact details, you need to inform us to ensure that all communication continues to reach you. Remember, the primary form of communication between Learning Live to its students is via email. Email us at training@live.edu.au to communicate your change of details.
4.9 Issuance of Qualifications
Certificates and Statements of Attainment are issued to students upon successful completion of a course or units of competency. The name you have noted on your registration form is the name that will appear on your Certificate. Please note your results will be withheld if you have any fees owing at the completion of the course.
Make sure you keep copies of your Certificate/ Statement of Attainment to show employers as this document states the modules and/ or competencies you have enrolled in and the results you have achieved. Please note a copy of the Certificate/ Statement of Attainment may be obtained by contacting Learning Live administration and quoting the course name and start date.
5.0 Conduct
5.1 Attendance
Regular and punctual attendance at classes is essential for successful completion of the course. Students who do not display regular attendance at their course will be required to attend a disciplinary meeting as outlined in the Disciplinary Procedures. Students are required to attend 80% of scheduled classes.
All absences are to be notified to Learning Live by 9:00am on the day of the absence. In the event of extended absence due to ill health or personal reasons, students will need to discuss their position with Learning Live Administration.
5.2 Student Code of Conduct
Learning Live provides an environment that is conducive to learning, ensuring safe, comfortable and supportive studying for our students. Students are expected to display a high level of personal responsibility for their learning process and for their interaction with staff members and other students.
The Student Code of Conduct aims to provide a safe environment by encouraging ethical and sensible behaviour of all Learning Live students. The following behaviour protocol is essential.
All students must:
- Respect each other’s needs and not disrupt students in their study and in the performance of their tasks
- Maintain a clean and safe learning environment
- Ensure all behaviour respects equal rights for all students regardless of gender, race, culture, age, religion, gender preference and abilities
- Be punctual
- Observe the Computer and internet usage guiding principles
- Care for each other and each other’s property
- Respond to any reasonable instruction from a member of staff
- Notify Learning Live if unable to attend class
- Ensure an equal opportunity for all students
- Conduct themselves in a business-like manner (including Neat and Clean attire)
In your own study you are expected to:
- Take responsibility for your own study timetable
- Approach your chosen program with personal commitment and integrity
- Complete all required assignments honestly
- Print your own assessments for submission
- Submit work that is your own in its entirety and adopting an individual approach to assessment
- Not use the copyrighted materials of Learning Live and claim it as their own
- Be respectful when contacting and communicating with other students and members of the Learning Live team
Inappropriate behaviour will result in disciplinary measures being taken. Inappropriate behaviour on Learning Live premises resulting in disciplinary action includes the following:
- Failure to attend the required minimum number of classes for any course without reasonable explanation
- Student attempts to cheat, plagiarise or otherwise act dishonestly in undertaking an assessment task, or assisting other students to do so. Students are considered guilty of cheating if they seek to gain advantage by unfair means such as copying another students’ work, or in any way mislead the trainer and assessor about their knowledge, ability, or the amount of original work they have done
- Student brings onto or consumes any drugs on the premises (except for drugs prescribed by a qualified medical practitioner)
- Student brings onto or consumes any alcohol on the premises
- Student exhibits any form of behaviour that is adversely affected by the influence of drugs and/or alcohol
- Enters into Sexual Activity with any person or persons on our premises or any training venue hired by Learning Live
- Failure to comply with any instructions given by a member of staff relating to the safety of any person or persons on our premises
- Inappropriate and personal use of the internet
- Continued use of Mobile Phones in class
- Student breaches the Computer and Internet usage Policy
- Discriminates, harasses or assaults (physically or verbally) any person or persons on our premises or any training venue hired by us
- Cheats and/or Plagiarises other students work and presents it as their own
- Damages or removes property or resources from our premises or any training venue hired by us or that belonging to other students
- Exhibits violent, aggressive, disorderly, offensive or disruptive behaviour towards students, trainers and staff
- Enters any part of the premises or any other place when not entitled to do so, or having entered, refuses to leave the premises
- Exhibits offensive Language, body language and/ or gestures
- Partakes in criminal activity on our premises or any training venue hired by us
- Conducts illegal activities on the premises
A breach of the Student Code of Conduct, inappropriate behaviour or Gross Misconduct will result in instant disciplinary action and may lead to immediate dismissal. Learning Live reserves the right to instantly dismiss a student who breaches the ‘Student Code of Conduct’. Learning Live will report all criminal acts committed by its students to the relevant authorities.
5.3 Disciplinary Procedures
Students who are found in breach of the Code of Conduct, or any other inappropriate actions will be advised verbally, in the first instance. If, after a verbal warning of inappropriate conduct is given and the student chooses to continue to behave in a way that is still inappropriate, the student may be asked to leave either the training session, or in serious misconduct situations the course in its entirety. If this occurs all fees will become due.
In any case where the Student Code of Conduct has been breached the following measures are in place:
- Incident Report will be completed by those involved in the breach (Please contact Learning Live administration for a copy of the appropriate documentation).
- Student attends a disciplinary interview with Learning Live administration and management as soon as possible after the incident. The student may have a third party present during the interview.
- The Interview will involve a discussion on the incident, the consequences and future behaviour if the student is to continue the course.
If the student is to continue the course an ‘Action Plan’ will be developed. This will state the agreed steps to be taken and monitored, to ensure further breaches do not occur. The ‘Action Plan’ will also state that the consequences of further misconduct will be instant dismissal.
The ‘Action Plan’ is to be signed by all parties present, and a signed copy is to be kept by both the Student and Learning Live.
The General Manager may impose the penalty of permanent exclusion from Learning Live in the case of physical or verbal abuse of students or staff of Learning Live, repeated or severe misconduct, in the case of criminal acts.
5.4 Complaints and Appeals
Learning Live will deal with any complaints and/or appeals in an effective and timely manner, ensuring that all parties are provided with equal opportunity to present their case. All formal complaints and appeals will be heard and decided within 15 working days of the receipt of the written complaint or appeal by Learning Live.
All Complaints and Appeals are referred to the General Manager or appointed representative. Learning Live will not consider assessment appeals that are raised 14 days or more after results have been issued.
In the first instance complaints or appeals should be discussed informally with the staff or trainers involved. However, if the complaint or appeal cannot be managed informally, the student can complete and submit a formal complaint in writing to training@live.edu.au outlining the nature of the complaint. At this stage the complaint must be recorded in writing.
Confidentiality is maintained concerning all complaints and appeals. The details of the complaint or appeal will only be disclosed to those who need to be involved in the complaint or appeal procedure.
5.4.1 Grounds for Appeal
A fair and impartial appeals process is available to all Learning Live students. If a student wishes to appeal their assessment or RPL/ RCC result they must in the first instance discuss the issue with the trainer and assessor. If the student is still not satisfied with the outcome after their discussion with the trainer and assessor a formal request must be made in writing outlining the reason for the appeal.
If an appeal for reassessment is substantiated, Learning Live will provide an independent assessment by a different assessor. Costs for reassessment will be met by the Learning Live. The outcome of the appeal and reasons for the decision will be communicated in writing to the student and a copy kept on both the Complaints and Appeals Register and the student’s individual file. An application for appeal will be considered where:
- A student claims a disadvantage because the trainer did not provide a course outline
- A student claims a disadvantage because the trainer varied without notification the assessment requirements as specified in the course outline
- A student claims a disadvantage because the assessment guidelines specified by the trainer were unreasonably or prejudicially applied
- A student is of the view that a clerical error has occurred in documenting the assessment result
Complaint/ Appeal Procedure
Speak to the person with whom you have the Complaint/ Appeal with and try to resolve the issue or problem in the first instance.
IF UNRESOLVED
Speak directly to your trainer, if applicable.
IF UNRESOLVED
Submit the complaint in writing. At this stage the complaint must be recorded in writing and signed and dated by the complainant.
The complaint will be reviewed by the Administration and Compliance Manager or representative, and the complainant will be contacted for further information if required. The Administration and Compliance Manager or representative will notify the complainant of the result in writing.
IF UNRESOLVED
If the complainant is still unsatisfied with the result, they may submit further information and the complaint will be referred to and reviewed by the General Manager. The General Manager will determine the final decision outcome. The General Manager or representative will notify the complainant of the result in writing.
IF UNRESOLVED
If the student is dissatisfied with the outcome they can choose to contact an independent body.
5.5 Computer and Internet Usage Policy
Use of Learning Live computers, network, and Internet access is a privilege granted to students and this use may be revoked at any time for inappropriate usage carried out on such systems. These resources are available to enhance your learning process in a supportive environment and to assist you to achieve quality learning outcomes.
Offences which are in violation of local, state, or federal laws may result in the restriction of computing privileges and they will be reported to the appropriate organisation and law enforcement authorities. Illegal acts involving the use of computer or internet access facilities may also be subject to prosecution by local, state or federal authorities.
For the benefit of all users, the following policies and rules must be observed:
- The use of computers including email for private use is prohibited
- Users will use computer equipment in an appropriate way and in a manner, which will not result in damage to equipment. Technical problems must be reported to a staff member, who will record the problem for the attention of technical support
- Do not swap around any equipment. That is, no changing of keyboards, mice or other equipment from one computer to another
- Do not add or delete any icons on the desktop, modification of computer settings is strictly prohibited. If the need for this action arises (due to learning outcomes) it must be done under the strict supervision of the trainer and MUST be restored back to its default state
- Computer classrooms will be locked when not in use. Students are not to be in the computer classrooms unattended
- No food or drinks are allowed in the computer training rooms, unless this has been previously approved by Management
- Do not load software, of any kind, on classroom computers. The downloading and installation of software including but not limited to: Web Toolbars, music, video streaming, audio (including radio), chatting programs such as MSN Messenger, Facebook, Twitter, MySpace, YouTube, IRC
- P2P sharing software, etc., is strictly prohibited
- Users will respect copyright laws and licensing agreements
- Students and participants will ensure that their work is backed up as Learning Live will not be liable for any loss of work
- All storage devises e.g., thumb drives, DVDs, must be virus scanned, prior to use. It is the student’s responsibility to virus scan, prior to use
- Users are not to deliberately propagate any virus, worm, Trojan horse, trap-door program code, key loggers, or any other code or file designed to disrupt, disable, impair or otherwise harm the network
- Do not attach any device to the network including notebooks, peripheral devices, etc, unless this has been previously approved by Management
- Users will not access materials, which would be considered as obscene, indecent or of national security risk (e.g. sending, receiving, or accessing pornographic materials). If such material is accidentally accessed, it will be immediately closed down and reported to a staff member, who will take appropriate action.
6.0 Liability and Applicable Law
To the maximum extent permitted by law and except where expressly stated otherwise in these T&Cs, Learning Live and its employees and agents shall not be under any liability whatsoever (whether in contract, tort or otherwise) for any cause whatsoever (whether occasioned by negligence or otherwise) for any injury, damage or loss, including indirect and consequential loss (including but not limited to loss of profits, loss of production, loss of data, loss of use or losses to persons or property) arising out of or in connection with a Learning Live training course.
Learning Live is not liable for any belongings that a participant brings to a training course. These T&Cs shall be exclusively governed by and construed in accordance with the laws of the State of New South Wales and submitted to the exclusive jurisdiction of the Courts of New South Wales.
Privacy Statement
1. Privacy
(a) Learning Live is committed to protecting the privacy of a participant’s personal information. As a training organisation, Learning Live manages a participant’s information in accordance with the standards designated under the Australian Qualifications Training Framework.
(b) Learning Live will provide access to a participant’s training records only to the participant or to another person with the participant’s written consent or if required by law or for auditing purposes with ASQA or other governing bodies. No other access will be provided. A fee may be payable for access.
